Legal Question in Immigration Law in California

I am a US Citizen.

I am 30 years old and a college student. I will be marrying my sweet heart in July 2010 and want him to come to the US as soon as possible because I am pregnant. How long will it take for him to come here. And since I am a student I don't have 125% above the poverty line to show. What is the easiest way for him to com to the United States?

- what country he is from?

- has he ever been to USA? If yes, when, how long did he stay?

- has he ever been deported from USA?

From your email it appears that your fiance is outside the U.S. at this time. If he is in the U.S., the marriage can take place here and all sponsorship paperwork can be filed concurrently, allowing him to gain resident status without departing the U.S. assuming that he entered the U.S. legally.

If he is not in the U.S., and you are planning on marrying abroad, then a fiance petition can be filed for him, allowing him to join you in several months and obtain resident status in the U.S.

An affidavit of support can be signed by a co-sponsor, and therefore it is acceptable if you have little or no income.
