Legal Question in Immigration Law in California

Dear Sir: I got my Green Card 3 years back for me and my family. now my daughter wants to study in India for undergraduate. she want to keep her green card valid. My wife also wanted to acompany her. they can come to US every year when there is a summer vacation for one month. could you please tell me what i have to do. thanks.

A permanent resident should make USA a place of her permanent residency, and not stay abroad for longer than 6 months at a time. If a person stays abroad a year or longer, there is a presumtion that she had abandoned her residency in USA.

A permanent resident can apply for a re-entry permit.

A re-entry permit applied for before departure by a permanent resident is one way of maintaining the intention to return to U.S. permanent residence and should be done. It is good for two years and can be renewed for another two while your daughter is an undergraduate.
