Legal Question in Immigration Law in California

Hello,

I have a question that I'd like you to help me. My niece was used to be a international student but her visa expired for a while. Now she and her boyfriend want to marry so that they can live together in US.He is an American citizen. But I wonder if she can really marry him and stay in US since shes practically illegal now.
