Legal Question in Immigration Law in California

Hepatitis C and immigration to US

I am a citizen of US and looking into starting my moms paperwork (I believe I have to file I-130) for her to immigrate to US. But she has Hepatitis C and I am not sure if INS will let her to come here because of that. I read what INS has on their website. It say that any alien who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to have a communicable disease of public health significance ineligible to be admitted to the United States.

These diseases dont include hepatitis C. Is it means she can be admitted to the US if all other arias they going to look at are fine? Do you think my mom is eligible to immigrate to the US with her hepatitis C?

You can still sponsor your mother to apply for immigration benefits. She may be eligible to immigrate to the U.S. if you file a 601 waiver together with your application and the 601 waiver is approved.
