Legal Question in Immigration Law in California

Hi,

I just got my green card this month through marriage but it's employment base because we got married before he got his green card through his company so it's a 10 years green card with no restrictions.

We are not doing well and would like to get a divorce. Can this have any kind of affect on me even though my green card is good for 10 years?! I'm currently pregnant with his child so that proves that it's bona fide marriage. It just didn't work out.

If you obtained your greencard as a derivative beneficiary of your husband's employment based case, then getting divorced will not affect your legal status. I do suggest that you seek assistance from a Family Law Attorney in CA to provide guidance regarding dissolution, child custody & child support.

Good Luck.
