Legal Question in Immigration Law in California

Hi,my mom recently applied for a Visitors Visa to USA indicating on the forms that she wishes to come over for 3 months,however she was granted a 10 year multiple visa.What is the maximum lenght of time can she stay here in USA on her first visit?

The immigration officer at the port-of-entry will determine the length of time that your mother will be able to remain legally in the U.S. This expiration date will be noted on Form I-94 that will be issued to her when she enters the U.S.

The maximum amount of time for a visit is six months. Therefore, if the officer asks your Mom what her intended length of stay is in the U.S., she should probably say a few months. If she says that she is here only for a specific event (to attend someone's birthday or anniversary on specific date one week from date of her entry, for example), the I-94 issued to her at the port-of-entry will likely be for less than six months.

Your mother will be able to extend her I-94 within the U.S. through an application requesting extension of status filed with the USCIS.

Usually, up to 6 months or as indicated on her I-94 card (as stamped by the immigration officer at the airport). She can't stay up to 10 years (this is a period of visa validity only).
