Can my husband get a marriage visa if he was caught crossing the border and banned for 5 years from the U.S?

I would say generally speaking without knowing the detailed facts the answer is no. I think you are talking about the 3 or 10 year bars but It depends on many facts like was he in the U.S. before he was caught. In any case, if he is banned then he will not be admitted until the time time limit has passed. A waiver of the ban can be requested in certain situations but they are very difficult to get. You should contact an attorney to know your rights and options, if any, under the law.
