Legal Question in Immigration Law in California
Hi I made a report for domestic violence but I did not press any charges, The police said they were going to arrest my husband anaway and the distric attorney will decide the charges. Either jail time or probation and some classes. I want to know what possibility he has of getting only probation or jail time. Also he is illegal and want to know if they will deport him. thank you

If he is illegal, he can be deported by ICE if found deportable. Crime of domestic violence by itself is a ground for deportation and can be a bar for admission to the United States.

The fact that your husband is in the US illegally and now has picked up an arrest for domestic violence may well subject your husband to an ICE hold if he goes into the California jail system as a result of the arrest resulting from the domestic violence event. If you are successful in fighting the case and he does no jail time (if this is a first time crime), then you may have deferred the problem for now. I am in Los Angeles.
