Legal Question in Immigration Law in California

Need second opinion

My boyfriend would like to get married but his Adjustment of Status is pending. His previous attorney said that since his Mom (US Citizen) petitioned/sponsored him, a change in his marital status would only delay the process of getting his green card. Is this true? I would think it would help expedite the matter. Can someone please give me a second opinion. Thank you.

Your attorney is right. When he is single, he is in the 1st preference immigration categoy. By getting married, he will be put to the 3rd preference category, which means more wait and delay.

The lawyer is correct, unless your boyfriend is Mexican, in which case the marriage actually would move him forward in the queue. (Also, if he is Filipino, the marriage would delay things, but by only a few months.) This might help you understand: http://snipurl.com/why_not_marry.
