Legal Question in Immigration Law in California
Hi, I received a petition approval for I-130 (daughter married & over 21) . I'm currently living in the US on E2 visa (business). Since I'm now in the US, can I change my status to a US residency?? please advise. Thank you.

In addition to approval, your I-130 Priority date must be current too in order for you to be able to apply for adjustment of status.
Look at the petition's priority date and check it against current Visa Bulletin date in your visa category. If it's current, you can apply for adjustment of status. If it's not current, you need to wait.

You can apply for adjustment of status in the U.S. provided that your priority date is current. According to the latest Visa bulletin issued by the U.S. Department of State the current priority date on cases in your category (married child of a USC) is 6/22/01. If your PD is not current, meaning an immigrant visa number is not available for you at this time, you will need to wait.
