Legal Question in Immigration Law in California

I recently got married to a U.S. Citizen. Prior to marriage, I had already submitted my I-485 and I am still awaiting the deicision on my I-485. Since my marital status has changed, do I have to submit another I-485 or can I simply send some type of documentation to change my marital status on my I already submitted I-485?

You need to clarify several moments about your situation before a legal advice can be given.

What do you men, you already submitted I-485? You applied for adjustment of status based on what? What is your eligibility/or who did petition for you? When the I-485 was filed? Did you submit it to USCIS or with Immigration court, etc?

You could likely interfile an I-130 petition and not have to file a new I-485, but it needs to be properly handled and monitored otherwise the government could easily get it wrong. These sorts of situations are best left to an attorney.

The above is not legal advice. It is general information and doesn't constitute an attorney client relationship. For further information, feel free to contact me directly on [email protected] or 818 609 1953.
