Legal Question in Immigration Law in California
if a resident alien is convicted of drug trafficking and attempting to cross drugs across the us/mexico border, does that individual lose his resident status? Is there any extenuating circumstances, for instance , age(70), length of time in USA(60yrs.), and/or health(poor), family members dependent on him for financial support? thank you

Yes, this resident will be convicted, then referred to ICE and Immigration Court for removal (deportation).
Old age and lenght of the resident are not an excuse in a drug trafficking case.

Hello:
The situation will vary depending on the facts. However, depending on when the crime was committed and whether you had any legal immigration status, there may be options for you. Additionally, you might be able to get criminal relief to get the crime vacated, or to try to get a full and unconditional pardon.
