Legal Question in Immigration Law in California

I was a victim of domestic violence and my child was sexually abused by that same person.We were an unmarried couple.My question is if their is any way I could get my permanent residence?I also have a police report for domestic violence.I also wanted to know if it makes a difference that the person that did this to us wasen't a permanent resident ,in what im asking?

I am sorry to hear about this extremely sad situation where a child was sexually abused. No, unfortunately, you can't apply for a green card under VAWA. The federal VAWA law affords protection to people married to abusive US citizens or lawful permanent residents. Unmarried cohabitants or people who are/were dating their abusers are not given this protection. You may be eligible for some other forms of immigration relief, such as U visa, for example (this should be reviewed by a lawyer). Talk to a free legal aid or an immigration attorney.
