Legal Question in Immigration Law in California

hi i will be going to Fiji to get married. can i bring my wife on visitors visa to US and apply for her I-130 here in USA. i would do a k-3 visa but i haven't seen her within two years or so. i know that wouldn't work for us.

Hi,

K1 visa has requirement for having physically met your fiancee within the past 2 years.

K3 is specifically to bring spouse to the U.S. after marriage has already taken place.

Entry on visitor visa does not allow for intention to immigrate to the U.S.

No, you will not be able to bring your foreign wife with you to USA immediately after marriage abroad. You will have to gather all documents in Fiji, come back to USA (alone) and properly apply for a spousal or immigrant visa ('green card') for your wife.

It will take at least several months or up to a year.

I suggest you get married then file for the K-3 spouse visa (together with the I-130) once you are back inside the U.S.
