Legal Question in Insurance Law in California
Accident Insurance
I am a victim of hit and run with liability only insurance.
The other car hit us and fled.
My insurance said they don't cover with the unisured motorist since we didn't get the other cars license number.
Can you confirm if this is correct.

Re: Accident Insurance
Unless you have uninsured motorist coverage on your policy, they are correct.
Re: Accident Insurance
I'm not real clear on your question. You state that you only have liability insurance, but you also say that your insurance company says they do not cover for uninsured motorist where you don't get the license number.
First question is whether you have uninsured motorist coverage. You find out by asking the insurance company and/or agent for a copy of your declaration page. THis will state your coverage.
If you do have uninsured motorist coverage then you need to get a copy of your insurance policy to determine whether the terms are correct, i.e., no license plate number no coverage.
I have lately seen situations where insurance companies are telling their insureds they have no coverage when they in fact have paid for such coverage. Therefore, you have to be real careful even when dealing with your own company. They are NOT acting in YOUR interests, they are acting in their own.

Re: Accident Insurance
Your post is unclear as to the type of coverage you own. Please review your declaration page of your auto insurance policy which will state whether or not you have an uninsured motorist coverage. If you do, then your insurance company is most probably incorrect about the license plate business. On the other hand if you do not have a UM coverage then you get nothing.
Good luck, and next time tell your agent to sell you a decent policy that includes UM/UIM (uninsured - underinsured motorist) as well as med-pay.
