Legal Question in Intellectual Property in California

Statute of Limitations Copyright Infringement

In a case for copyright infringement how long is the statute of limitations? The circumstances are that the Plaintiff filed a case against an unknown John Doe 5 months ago and has yet to find/serve Doe. Does service need to be within 1 yr of filing or of 1 year of knowing of the infringement, or is it a greater amount of time?

Re: Statute of Limitations Copyright Infringement

The statute of limitations is 3 years but calculating it in a particular case can be complex. The case must be filed in federal court. The attorney who filed the case will know how to serve the defendants.
