Legal Question in Juvenile Dependency in California
Can I see my child for Christmas?
I am a father in a juvenile dependency case. Mother beat the child, judge took child away from mother for 6 mos and put child in my custody. After 6 month review hearing, judge puts child back with the abusive mother, and I only see child every other weekend. Juvenile case still open, and not scheduled to end until next year.
Prior to juvenile case intervention, family law order states parents are to share the 2 week Christmas school vacation.
Social worker assigned to juvenile case states he can't do anything against juvenile order, but wont make a recommendation to judge for me to see my child for 1/2 of Xmas break. My court-appointed lawyer is of no help either.
What can I file (or force my appointed attny to file) in juvenile court requesting they allow me to see my child for an extended period during Xmas holidays (similar to our family law order)?
I have not been charged with anything in juvenile court. Why should my time with my child be lessened as a result of mother beating child??
