Legal Question in Employment Law in California

100.00 taken from check.

My grandson who is 16 was employed

as a box boy after school. His work was

found to be better than adverage but

one day two of the box boys were

taking the ruined produce out to the

trash bin when one boy threw a cracked

egg at another boy and then my

grandson threw on egg at the backwall,

anyway long story made short, the two

boys who were asked if they had thrown

eggs said yes. The manager took

200.00 .100.00 from each boys their

final paycheck without pior notice or

consent.The two boys offered to clean

the egg fom the wall but was refused by

the manager. Is that legal?

It is illegal to take money from a pay unless the employee has executed an agreement providing authority to do so. He can contact the California Labor Commissioner and file a complaint or contact the employer directly. There can be penalties imposed for doing so without permission.

However, the employer always has the right to collect the money through small claims court.
