In additional to filing a workers compensation claim, since it sounds like your back condition qualifies as a disability (or your employer at least perceives it as such based on the fact that you were sent home) if your employer has 5 or more employees, your employer has an affirmative duty to try to reasonably accommodate your back condition. This means that your employer has to have a conversation with you about how your job can be modified so you can perform your job. If there is a way that your job can be modified that is not unreasonably difficult for the employer and that is safe for you, the company needs to make the modification. If your employer fails to do this, please feel free to call our office at (213) 536-4236.
