Legal Question in Employment Law in California

Background Check - can you be fired for refusing

Can an employee be fired for refusing to submit to a background check after they've been employed for years. The employer has a new policy that they can conduct periodic checks whenever they want for any reason whatsoever.

I would need to know more information before answering this questions. Are you bonded and is this really a requirement of the bonding company? Do you have an employment contract with your employer or are you an employee at will? If a contract is in place then that will govern the right to request information. If not, then you can be fired for any reason or no reason at all.

There are laws designed to protect employees, but the answer depends upon a lot of circumstances, such as job responsibilities, need for bonding, grounds for suspicion, etc. Please call to discuss your facts in order to get an informed opinion. 714 960-7584
