Benefits denied

I have been working for 10 months as a part time employee (32 hours a week). I have been told that I can work as many hours as I want, but they don't want to offer me any benefits. All full time employees are offered benefits. Can they deny me benefits if I work 40 hours a week?

Some recent court decisions hold that if you work full time, you are entitled to full time benefits, retroactively. If interested in pursuing a claim, contact me.
