Bonus

I live and work in CAlifornia. My employer is St Louis based. If I earn a bonus in 2004 and resign before the bonus is actually paid out is my employer still required to pay me?

They have a stipulation that I must be on the payroll when the bonus is paid out.

In general, bonuses are discretionary and the employer has the right to place conditions upon receiving them. If one of those conditions is that you must be employed in order to receive the bonus, there is nothing illegal about that.

You already knew the answer - their policy determines payout. I wouldn't quit before being paid if the bonus is substantial.
