The California Fair Employment and Housing Act makes it unlawful for an employer to harass any employee on the basis of their sexual orientation, which this seems to be. Since the conduct is discrimination and harassment as defined as actually �illegal� under the Civil Rights statutes, yes you would have grounds for suit.
