Legal Question in Employment Law in California

Breaks

I have worked in a privatly owned restaurant for over 5 1\2 years now. I work fulltime, 8 hours a day five days a week. I and some of my fellow employee's do not get any rest or meal periods during our shifts. The restaurant has changed ownership in April of 2005. The former owner sold the business to her son. This situation has existed since I began working in December of 2000. What are my legal options to pursue this?

You can complain to the CA Labor Dept. You're entitled to breaks.

You are entitled to one 30 minute meal break and two 15 minute rest breaks during your 8 hour shift. You may either find a private attorney to handle your case, or you may file an action with the Dept. of Labor Standards Enforcement (DLSE). You may find your local office at their website:

A claim of violation of the wage and hours rules. You could recover compensation for all the denied or unpaid breaks and meals, plus penalties and interest if handled correctly. Feel free to contact me if interested in doing so.
