California Over time Labor Law
I need to know what the law states for california regarding overtime, over 8 hrs is over time ? or over 40 hrs?

Yes, and yes; with numerous exceptions. If you believe you are owed OT, then you need to talk to the Labor Commissioner, and if they agree, they will have you file a claim. Then, if the amount is high enough to justify it, you can hire counsel to represent you in the hearings and trial. If so, call to discuss. 714-960-7584

In California, overtime could be due for more than 8 hours in a day OR more than 40 hours in a week, with several exceptions. You should either consult with an attorney or take your claim to the Division of Labor Standards Enforcement. You should also be aware that employers who are not fully paying time owed may also be violating other provisions of the Labor Code.
