Legal Question in Employment Law in California

Hi- I would like to know if I may be able to change my hours at work due to hardship. I am going through a divorce and will have physical custody of my 2 kids. I am currenlty working on a swing shift schedule a few days a week. My schedule used to be regular daytime when I started for 3 years until my boss took those hours from me. I have since worked those swing shift hours but with the change in our Family, I am in need of the change. Please help. thank you so much.

You can try to persuade and negotiate whatever you desire from the employer, but you have no right or power to compel. The employer is entitled to determine, set and change hours, duties, titles, compensation, benefits, leaves, vacations, holidays, policies, rules, etc. just not retroactively. You can always look for a new job that better suits you.
