Legal Question in Employment Law in California
Collecting on a Wage Claim, + Treble damages
I just had a meeting with a Labor Commisisoner over $20,000 in Unpaid Wages. I believe I'll win (slam dunk).
Does the State vigorously try to collect Unpaid Wages, after a Judgement?
And, do they warn the former Employer that if Unpaid Wages aren't paid in 10 days, they'll face treble damages? (Do they enforce this? Or do I have to request the State to enforce this?)
FYI, my former Employer has a $2 Million home, a sail boat, 3 cars, and vacation property.
Thanks!

Re: Collecting on a Wage Claim, + Treble damages
Nobody but you does anything to collect a judgment. Once and if you get one, you will have a piece of paper entitling to do go do it. You're a long way from getting one, since the process can involve a contested hearing [mini-trial] at the Labor Commissioner, followed by an appeal and new trial [do over] in Superior Court with the company usually represented by counsel. Unless you know how to conduct those trials, with fights over evidence, you should get an attorney who does. Feel free to contact me if serious about doing so.
