my company won't pay me for my overtime if i go over 12. I'm out on the field every day sometime i won't have any break. Can they be sue for that?

In order to provide an accurate answer to your question we will need to know:
1) Your job title;
2) What type of work you are doing (your actual job duties that you perform each day);
3) How you are paid (hourly, salary, commissions, etc.)
There are job positions for which no overtime is ever required
If your are an hourly paid person, you are entitled to OT. If not paid, then you can file a claim with the Labor Commissioner for the money due, plus interest and penalties.
