Company Shuts Down Without Paying Employees

The assests of the company I worked for (equipment, inventory, patents, etc.) were sold yesterday under California Commercial Code Sections 9610, 96111, and 9613. They intend on re-opening and continue manufacturing.

Since the assets were not sold under the law ''pertaining to the general assignment for benefit of creditors'', it appears the employees owed back wages and vacations will not receive their money.

Is this possible and is there anything I can do to get the money I am owed?

There are provisions for obtaining payment of wages earned within the last 90 days. You might try filing a complaint with the labor commissioner. If you wish to discuss further, please call me at 805/641-6600.

File a wage claim with the Labor Commissioner and consider hiring an attorney to represent you in the hearings and trial. Contact me if interested.
