Legal Question in Employment Law in California

My company has a strange calculation for my overtime pay. Can I be considered exempt and non exempt at the same time?

No. Salary Exempt is the only classification that is not entitled to OT. If not properly paid, you would have a legal claim for unpaid compensation and OT, interest, penalties, and attorney fee recovery if you win at trial. If serious about pursuing this, feel free to contact me.
