Legal Question in Employment Law in California

To whom it may concern,

Can a perspective employer in California disqualify you because you do not have a car to travel to work even if you can take public transportation to commute to work? The question asked by the perspective employer was do I have transportation to commute to work. My response was yes I can take public transportation. I have not yet heard back from the company.

Not only are there no laws against 'unfair treatment' or poor management, but the employer is entitled to set and change hours, duties, titles, compensation, benefits, leaves, vacations, holidays, policies, rules -- including hiring standards and requirements -- unless the company policies or decisions are based upon illegal discrimination, harassment or retaliation as defined under the ADA [disability], Civil Rights [age, race, sex, ethnic, religion, pregnancy], FMLA [medical leave], Whistle-blower, or similar statutes. I don't notice 'lack of transportation' as a listed category of immutable characteristics protected by law.
