Who is considered a "Military Spouse" in regards to the new FMLA for a qualifying extigency? Is it people who are legally married, legal domestic partnership, domestic partnership, or is it up to the employer?

If a service member asserts 'spousal' privileges for a homosexual partner, he is going to run head first into 'don't ask, don't tell' policy and involuntary discharge. Other than that, the private employer's company policy and state discrimination laws will have to be consulted to determine private employees 'rights'.
