Contingent recruiter / vs employer

I am a recruiter for a company. An applicant sent her resume to us on 2/23. I forwarded the resume to a manager in the company on 2/24. The manager went on vacation. Meanwhile the candidate contaced an outside recruiter who then submitted the candidate to our manager. The manager explained we already had the resume. He says he would be owed the fee if we hire her as we hadn't actually spoken to the candidate prior to him sending. Could you please let me know if this is true?

If you already had the resume, and you told them so, no fee is owed. Tell the mgr to bone up on some basic contract law.
