Legal Question in Employment Law in California
my daughters boyfriend found money on the ground next to his car during his break. He kept it and his employer called him in about a week later and asked if he found money. He told them yes. They fired him and told him if he didn't turn in the money he would go to jail.
Can they fire him for not turning in lost money in the parking lot?

In general, unless an employee is civil service, in a union, or has a written employment contract, they are an 'at will' employee that can be disciplined or fired any time for any reason, with or without cause, explanation or notice. Thus, of course they can fire him, but they can not make him give them the money, nor can he be charged with a crime for simply pocketing the money. Now if he actually stole it from someone by taking it from a car or purse, etc., that is a crime.
As Mr. Nelson indicated, they could fire him for not picking up a gum wrapper in the parking lot.
