Legal Question in Employment Law in California

dental insurance premiums from paycheck

My employer deducted insurance premiums from my paycheck but was not forwarding the money, so I have received a big dental bill for having no dental coverage. My employer said they will pay my bill but have not done so. I actually want to be refunded for the premiums I paid after my coverage ended since they are not paying the bill. Have they broken any laws and how can I get my money back?

Re: dental insurance premiums from paycheck

You would be entitled to refund of premiums 'fraudulently taken', and the employer owes the amount that insurance would have paid on your claim. If they don't pay voluntarily, your remedy is the same as anyone else's, file suit. If it is worth enough to justify hiring an attorney, feel free to contact me.
