Legal Question in Employment Law in California
Difference between Public and Private Businesses
I myself work for a Private Business
and they act like they can do anything, As in, make us stay past our scheduled hours, work off the clock, if I call in sick they say they will fire me, make me do other positions then what I was hired to do. I have been working for this place for 1 year and 7 months and was wondering if since they are a private business they can do this.

Companies set hours, rules and pay. However, you must be paid all your hours worked unless salaried. If they shorted you, you could file a claim with the Labor Commissioner. Nothing requires they be fair, reasonable, good managers or decent human beings. If you don't like their attitude, you can look for other work.

If you are an hourly (non-exempt) employee and working any amount of time "off the clock" your employer is violating California law. You must be paid for all time you work. Who is your employer? This is a clear violation of the California Labor Code.
