Legal Question in Employment Law in California

I was discharged Sept.30th from my job.When that happened I also lost my medical insurance the same day.Now i have no insurance,And I haven't received anything from cobra as of today.Should my insurance be paid a month ahead from my previous employer.I have medications that i need to take on a regular basis and cannot afford them.Do I have any recourse.

Your cobra election, if you choose to go that route, should be retroactive to the date of termination, provided you pay on time once you make the election. You should politely bug your employer for them to get you your cobra materials. Your other alternative, which is almost always cheaper, is to find your own private health insurance. It's ugly expensive, but cobra is almost always super ugly expensive.

Your employer is supposed to provide you COBRA option paperwork within 30 days of termination. Contact them immediately to try to get that coverage handled. That will maintain your coverage without gap.
