Legal Question in Employment Law in California

Can an employer make you do things at home every night and not get paid for it. My employer recently changed policy that we have to fill out our time sheet everyday instead of on the 1st and the 15th. Can they make us do this without paying us? Can they dictate what and when I do things off the clock?

No, if you are doing your work you are "on the clock."

The employer can dictate when and where you work, within the limits of the Labor Code's wage and hour rules, but if you are working at the employer's direction, you are entitled to be paid for all the time. If not, paid properly, you can file a claim with the Labor Commissioner for unpaid compensation, penalties, interest, and if successful your attorney fees. If the amount due is substantial, and if there are multiple workers making this claim, you should consider hiring an attorney. If serious about doing so, feel free to contact me.
