employer not paying

I am a flooring installer. I work 1099 for a company. My employer has not paid me for 2 jobs and the 1st job was done 4 weeks ago. My employere states that a moisture test was not done at the second job so he is not paying me for either because the floor has to be ripped out and he is expecting me to pay for the new floor. I only do what is ordered to me on the job. The moisture test was not asked for. Are they within their rights? We are talking about $4000 in paychecks.

Either file a wage claim with the Labor Commissioner or file suit.
