Legal Question in Employment Law in California

My father recently died he was 74.His employer was paying him 2000.00$ a month retirement. or hrly wages far less than the average superinteant when is was working construction. My father always told all of us that he and Al (co. owner) had agreed to continue paying his retirement to my mother untill she passes. there are many more pressing issues. He has not paid one cent since my dad passed on jan 26 2010. Should we go after him?

If he had a written agreement to that effect, with specific terms detailed, then consult with a local attorney to get an opinion whether it is enforceable under federal law governing pensions or as a contract.
