If you are being picked on because of certain characteristics, such as race, gender, national origin, age, sexual orientation, disability, and the like, that would be illegal and actionable. If it's just someone being nasty because he/she does not know how to deal with people in a work environment, that might not be actionable unless you suffer from mental distress which could be covered under workers compensation. Unless you are complaining of Civil Rights violations based upon race, religion, age, sex, etc., being 'picked on' is not illegal.
