Legal Question in Employment Law in California
I need to find out what to do in my situation. I think I am a victim of a hostile work environment, but I am not sure. I need out of my company, but I worry about quitting and not getting unemployment, and I don't feel it's fair to collect half of my salary when I feel forced out of work. I am wondering, even, if there is legal action that I can take (sue). I have been with the company for three years, I have never received a review or raise. I have been demoted in my responsibility, and have received paycuts. This is not unique to me, the company is doing what it can to survive. However, since the changes, employees have become angry and hostile. Mainly one coworker and my direct boss. They spend the day whispering and making comments about employees and customers. They call names, speak disrespectfully, make jokes. I spend my days listening to ridicule, afraid to ask anything, crying my whole way home. Something must be able to be done about this? Stay or leave, the choice is yours, but what you describe is not 'hostile environment' under the discrimination laws, merely a poorly supervised place to work, which is not illegal.
