Legal Question in Employment Law in California

Fired employee asking for documents

A terminated employee was denied unemployment due to ''refusal to follow simple instructions''. She is now out to get me according to other employees. I received an email from her asking for client surveys that mentioned her in a positive light (1 out of the 200 we have received) as well as a letter she wrote complaining about the way people act at the clinic that she requested remain in her employee file. Do I have to give them to her? The surveys seem to be the property of the hospital and I would think she should have a copy of her letter. I already provided EDD with all of her reviews and she demanded copies of them, which I have already sent her even though she received copies at the time of the review. I am starting to feel harassed.

Re: Fired employee asking for documents

Companies have no obligation to provide to employees any document copies from their file, except things signed by the employee. Politely tell her she is not entitled. You have nothing to lose doing so. IF she sues, then she could subpoena whatever she wants. Unless she has valid grounds, don't worry about it.
