Legal Question in Employment Law in California

Fired immediately after achieving hiring goal

1) Hired by a family-owned business in Oct 2002 to implement an ISO 9001 Quality System for a company without any formal quality system.

2) Achieved goal on 01/22/04(recommended for registration to ISO 9001:2000) by a certification service company at the end of the initial three day audit (goal accomplished 3 months ahead of schedule on initial attempt).

3) On 01/23/04, I was told by the owner (President) that my services were no longer needed and that I should leave. The owner never wanted the certification - the effort was supported by the son (VP/GM).

I was told that I could submit a proposal to consult for them and keep the system going.

Questions:

A) Do I have any legal recourse?

B) The proposal to consult on an ad hoc basis was signed. Does this destroy my ability to file for unemployment?

Re: Fired immediately after achieving hiring goal

Welcome to the world of 'at will' employment in CA. Unless you have a written contract for specified term that defines your rights at termination, you probably have unwinnable case. The best an attorney can do for you is attempt a negotiated settlement of your claims [anyone can file a lawsuit, even if it can't be won]. If interested, contact me to discuss. Consulting offer should not bar unemployment application.
