Legal Question in Employment Law in California
fired, got new job...person called new employer to tell new employer I was fired
I was let go from an employer in July of 2002 and landed a new job in August of 2002 with another employer. When someone found out who I got a new job with they took it upon themselves to notify the new employer that I was let go for an activity that was questionable and was much later(after I was hired) prosecuted as a misdemeanor. The individual that called worked for the employer I was let go from, as a result of the phone call that was made I was let go from the new job because, according to them, the phone call they recieved was the result that led them to investigate me even though the hiring of me was totally legitimate. The new company was totally impressed with my work but had to let me go because of a ''backround check''. Do I have a right to go after the company that originally fired me since a representative of theirs called the new company and as a result got me fired? I have not been able to obtain a job since and have been unemployed for about 10 months.

You have grounds for suit if the old company made unsolicited call to the new company. That sounds like they were trying to get you fired, and did. If interested in discussing the facts and strength of the case, contact me. Also, it may be possible to negotiate a settlement without suit if the facts are strong.
