Legal Question in Employment Law in California
I gave over a 4 week notice to terminate employment with an employer due to stress, and lack of help in my area. Prior to my decision to terminate I asked for help on multiple occasions as the work load was unbearable, and the one person they had in place was not knowledgeable enough to assist and consistently depended on me for answers. The company has stated many times in meetings that employment with them is at will. Every time they hired a temp or new employee, they would never send them to my department, and therefore short staff. One of the clients referred a marketing representative to contact me regarding a seminar, at which time I asked the representative to fax the company information attention to me, and I would pass the information along, which I did. When I decided I wanted to attend, I phoned the representative back, and explained that I wanted to use my personal companies name to pay for the services and to email me a confirmation at my personal email. I received the email, but nearly a month later I received a fax at my work place asking that I sign the receipt, and fax it back. The next day, I was terminated sighting, running a competing business was a conflict of interest. The employer originally filled out the separation notice as I voluntarily quit, when I reminded her that I was willing to work throughout my notice, and if she was terminating me she would have to also mark the box that I was being terminated. I am now filing for unemployment benefits, do I have a chance to collect?

If you quit work, you are not entitled to unemployment. You gave notice of resignation.
