handicap parking

I have a handicap parking pass for the state of CA. my employer says that I may only park on the 4th floor of the parking structure (all Hourly employes park in a sirface lot) no to go in to the employee entrance I have to ride one elevator down to the 3rd floor then walk across the parking garage (about 100yrds) to another elevator then down to the ground level. this is a major pain. there is handicap parking on the 3rd level and this is where all of the salery employees park. is this legal? can they tell me that I cant park in a handicap spot? thanks for you help

You can seek information and assistance from the Dept of Fair Employment and Housing. The issue of parking is at best a 'grey area' as to what the rules are. They have to be analyzed on a case by case basis to see if 'reasonable access' has been given to both employees and to customers and the public who also have a right to use placarded spaces. If, after discussing it with DFEH, you believe there is a violation, feel free to contact me for legal help if serious. Regardless of what DFEH says, an attorney may be able to informally resolve the situation by negotiation with the company on your behalf; that's why people hire attorneys as 'mouthpieces', for the leverage.
