Harassed and Terminated

Sexualy harassed by co-worker(sexual orientation) reported him to lesbian Manager twice and now manager denies it. Harasser retaliated against me interfering w/my work creating me problems w/supervisor who scolded & held me responsible for harasser's wrongdoings. I complained 2 supervisor about the harasser interfering w/my job many times but did nothing about it. Supervisor offered permanent job & even sent me to H.R. for hiring but terminated me after my many complaints. His reasons for terminating me were not truth. Supervisor also discriminated against me & treated me different than he treated co-workers when he learned of my sexual orientation. What can i do ?

As with any case for discrimination or sexual harassment, your case is only as strong as the evidence you have to prove your claim. If the employees deny everything you allege, you will need witnesses. If you have witnesses, they need to be interviewed by someone investigating your case. This can either be done through a private attorney or a public agency such as the California Department of Fair Employment and Housing or the U.S. Equal Employment Opportunity Commission.

You should meet with an experienced employment law attorney in your area to discuss the facts of your case to get an assessment of what you have and what needs to be done. Be aware that there is a one year statute of limitations from the time of the unlawful acts to file a claim.

Well, IF you have witnesses or documents that would prove your claims, you have grounds for a lawsuit. Proof is always the problem; your word is not sufficient. Usually there will be someone who saw and heard the situation, or there may be evidence or reference to your situation in memos or other documents.
