Legal Question in Employment Law in California

Harassment at Workplace

I was recently harassed and verbally abused by--name removed--coworker. Now the company is doing an investigation and claims its an 'he said, she said' issue and posted me and the coworker on suspension. What are my rights and what can I do to stop the harassment?

Re: Harassment at Workplace

A company is not allowed to retaliate against you for filing a complaint of harassment. I don't understand why you were placed on suspension. You should be able to complain of harassment without being suspended. Were you interviewed as part of the investigation? If the company did not follow certain standards in conducting the investigation they could face liability.

Re: Harassment at Workplace

Your company seems to be following the right strategy. They have to conduct the investigation into the allegations no matter whether they are true or not, as they have no way of knowing.

As an employee, you are entitled to the report that reflects the nature of investigation and the findings. The investigation should be conducted by an unbiased person/entity.
