Legal Question in Employment Law in California

Harrassment?

I am in outside sales for a chemical company. I have been on family berevement leave for a couple weeks. In that time my company designated from our corp. office someone to contact all of my clients via phone to tell them that I am on medical leave and they need to place any orders with corp. Is it legal for them to disclose the fact that I am on medical leave to my clients? All of my clients have been calling me direct and it is causing my blood pressure to go through the roof! I have Dr. proof. - Thank you.

Re: Harrassment?

That -is- a personal issue that should not have been disclosed. At the same time, they protected you in a sense so that your clients wouldn't think you're on disciplinary leave. They could have said "he's taken a few weeks off" and left it at that, though. It's nice that your clients care so much about you.

Such discussion of an employee's medical condition is a violation of privacy. Whether it justifies legal action depends on the severity of the violation, and the damages. Contact me if you think you want to take legal action.
